
From July 1, 2025, new regulations come into force that will change real estate market. Some will make life easier, others… complicate. We prepared complete guide.
MOST IMPORTANT CHANGE: Mandatory energy certificate for EVERY transaction. No certificate? No sale. Penalty? Up to 30,000 PLN. But attention – certificate must be “new type”, including CO2 emissions. Old ones valid until end of 2025.
The Nowaks are selling apartment from 1970. Certificate showed class G (worst). Had to lower price by 50 thousand. “If we knew earlier, would have replaced windows” – they regret.
SECOND BOMB: New tax on “flipping”. Selling apartment before 2 years? You’ll pay 15% on profit. End of quick investments. Exception: first apartment, inheritance, divorce.
In Warsaw effects already visible. Investors holding sales. “I’ll wait these 2 years” – says client who bought 3 apartments in 2024. Prices short-term might drop.
GOOD NEWS: Land registry digitalization starts full speed. From July in 5 cities (Warsaw, Krakow, Wrocław, Gdańsk, Poznań) online extract in 24h. Cost? 50 PLN instead of 200 PLN. Time? 1 day instead of 2 weeks.
CONTROVERSIES: “Right of first purchase” for municipalities expanded. City can buy any apartment listed for sale at advertisement price. Has 30 days for decision. In Berlin similar regulation paralyzed market.
Here still calm. Krakow announces will use only for “bargains”. But uncertainty already affects market. Some sell privately, bypassing advertisements.
FOR LANDLORDS: End of black market contracts. New rental registration system. Every contract to office within 7 days. Don’t report? Fine up to 10,000 PLN. Plus automatic info to tax office.
POSITIVE FOR BUYERS: Extended developer warranty. From 5 to 7 years for hidden defects. Plus new guarantee fund – if developer bankrupt, state will finish construction.
WHAT ABOUT LOANS? New KNF guidelines: max 35% income for payment (was 40%). Young from Krakow already feeling. “Instead of 500 thousand we’ll get 450” – Młynarski couple complains.
CURIOSITY: From September mandatory “housing CV”. Seller must disclose EVERYTHING: flooding, renovations, neighbor problems, even past deaths in property. In France works for years, here raises controversies.
